Chang Xinmin, the chief of the Hunan Provincial Association: two cases need to be re-examined

[Direct report network Beijing January 25th news] (Morning News Direct State) "Set up evenly, do not even if you do not (not) engage in such a slang, does it highlight the helplessness of direct sales?

In a well-developed industry, setting up an industry association is a natural process. At present, in China's direct selling industry, in addition to the China Foreign Investment Enterprise Association Direct Selling Industry Committee, there is no national direct selling industry association. However, there have been two provincial-level industry associations in China, namely Hunan Direct Sales and Store Sales Association and Guangdong Direct Selling Enterprise Association.

Recently, many direct selling companies such as Quanjian, Hualin and Infinitus have been caught in the whirlpool of public opinion. Among them, Quanjian and Hualin are involved in pyramid schemes, which has aroused widespread concern in the industry. Then, as a specialized industry organization, what work does the industry association do, what work will be done in the future, how should the direct sales develop in the future? Direct sellers interviewed Mr. Shi Xinmin, the president of the Hunan Provincial Direct Selling and Store Sales Association.

Shi Xinmin

President of Hunan Direct Sales and Store Sales Association

Former Deputy Director of the Anti-ML Marketing Office of Hunan Province

Shi Xinmin believes that the power-sounding event has occasional elements and inevitable factors. Any industry, any business, or any enterprise, as long as it has evolved into fraud and swindling consumers, as long as it has a bad influence on the country and society, no matter how big it is and how hard it is in the background, it will eventually die. Because the principle of consumer interest is the basic principle of the market economy.

Review the two regulations. In recent years, the call for the revision of the Direct Selling Regulations and the Prohibition of MLM Regulations has become stronger and stronger. The power-related incident triggered a series of direct selling companies to be rectified due to violations of laws and regulations. The industry is calm, and some experts have revised the two regulations. Before serving as the president of the Hunan Provincial Direct Selling and Store Sales Association, Shi Xinmin served as the deputy director of the Hunan Provincial Anti-MLM Office. He has been in the front line for many years and has deep experience in the practice of the two regulations. He said that in order to meet the needs of joining the WTO, in 2005 the Ministry of Commerce and the former State Administration for Industry and Commerce (now merged with the State Administration of Markets and Regulations) rushed to draft the "Direct Selling Regulations" and the "Prohibition of Pyramid Regulations" based on the national conditions at that time. The two regulations have been serving the market for 13 years.

Shi Xinmin said, "I am blunt, these two regulations are hard to be hailed as 'good law', and some of them are contrary to reality, some are vague, some are contradictory. I am fighting against MLM and direct sales. After doing it for 28 years, I always feel that the 'two regulations' can be left or right in the specific implementation, but can be up and down, and there is no such thing as a monologue. In the direct selling industry, there is such a buzzword: 'If you put it flat, you can do it. (Don't) engage in '. What is the 'flattening'? There are hidden rules. Therefore, for these two regulations, repairs are abolished, the Ministry of Commerce and the State Administration of Market Supervision should pay attention to and re-examine."

Direct selling companies do not want everyone to be at risk. January 8th, by the State Administration of Markets, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Civil Affairs, the Ministry of Housing and Urban-Rural Development, the Ministry of Agriculture and Rural Affairs, the Ministry of Commerce, the Ministry of Culture and Tourism, the National Health and Health Commission, the State Radio and Television 13 departments including the General Administration, the State Administration of Traditional Chinese Medicine, the State Drug Administration, and the State Internet Information Office jointly launched a 100-day joint rectification campaign for “health” market chaos, demonstrating that the central government maintains market order and protects consumers. The determination of rights and interests. The direct selling industry has survived for 28 years in China, indicating that it is alive. Direct selling is a kind of sales format. Both industrial and agricultural products must be sold out. Under the framework of the socialist market economy, the state allows multiple market sales models to exist. Therefore, it faces a thousand-day rectification of 100-day rectification actions, direct selling companies and Practitioners should not be worried, and no one needs to be at risk. However, the direct selling industry has coexisted in the past. "I think, no matter how the government rectifies, as long as it does not violate the law and regulations, it can be boldly operated. Because the big waves are sanding, gold will stay and it will shine." Shi Xinmin said.

The key to the direct selling industry is to cultivate internal strength. “The most serious thing in the direct selling industry is to engage in fraud. For example, some direct selling companies regard donation and sponsorship as face-to-face projects. The tone is high, the movement is big, and the sense of social responsibility is strong. In fact, this is the guise of the government and Consumers play the 'eye-blocking method' in front of consumers. I think the most important thing for direct selling companies is to train their internal strengths, be honest and trustworthy, improve their performance, pay taxes according to the regulations, do a good job of 'this share', and do as much public welfare as possible."

Finally, Shi Xinmin emphasized that direct selling companies must be strict and self-disciplined. They must eliminate the four major problems of “false propaganda”, “virtual high pricing”, “layered retention bonus” and “tax evasion”.
